LIVEDAB GmbH – The Filter Company (hereinafter: LIVEDAB) informs customers about the processing of customer data when using the applications provided by LIVEDAB for customers (short: LIVEDAB services) in accordance with the requirements of data protection regulations – among others, Regulation (EU) 2016/679 (General Data Protection Regulation [GDPR]), other data protection laws in force in the Member States of the European Union (EU) and other data protection laws.

Section 1. Description

Visits to the website provided by LIVEDAB to customers

(here in the following: Website) are possible without providing information about the person (so-called informational use). LIVEDAB only stores access data without personal reference in the case of informational use; within the inevitable server statistics, however, such data is automatically stored, which is transmitted by the browser of the respective user (so-called server log files):

  • Browser type/version
  • Operating system used
  • Referrer URL
  • User’s IP address
  • The date and time of the server request
  • websites visited
  • Access status / http status code
  • Transferred amount of data

The processing of this data serves to display the website correctly to users and to optimize the website as well as to ensure the functionality of the information technology systems – for example, also to protect against abusive interference with the LIVEDAB services. The legal basis is Art. 6 sec. 1 p. 1 lit. f GDPR.

The data of the log files are stored separately from any other personal data of the users. LIVEDAB merges the stored server log files – not with other data sources.

The data of the log files will be deleted no later than 30 days after the end of the visit to the website.

Section 2. User management

However, the use of the LIVEDAB services provided to customers requires prior registration and successful registration with agreement to this Privacy Policy as well as the Terms and Conditions for the use of the LIVEDAB Services.

For the login, the user name or the e-mail address and the corresponding password must be entered.

LIVEDAB uses a service of Auth0 Inc., 10800 NE 8th Street, Suite 600, Bellevue, WA 98004 / USA for the purpose of authenticating customers of the service “Auth0” – i.e.

The use of this third-party provider serves to safeguard the legitimate interests of LIVEDAB and is based on an order processing contract in accordance with Art. 28 sec. 3 p. 1 GDPR. The legal basis is Art. 6 sec. 1 p. 1 lit. f GDPR.

Section 3. Cookies

In order to make visits to the LIVEDAB website attractive and to enable the use of certain functions on it, website cookies as well as similar technologies (e.B. web beacons) are used, which can be used to collect information automatically when users visit the LIVEDAB website.

Cookies are small text files in the sense of alphanumeric identifiers, which are stored on the respective terminal device of the user when visiting a website. Cookies serve a number of purposes: for example, they help with efficient navigation between different websites, enable the recognition of presets and generally contribute to the improvement of the user experience.

Some of the cookies used by LIVEDAB are deleted after the end of the browser session, i.e. after closing the browser (so-called session cookies); other cookies remain on the user’s device (so-called persistent cookies).

The use of cookies serves the optimized presentation of the website. The legal basis is Art. 6 sec. 1 p. 1 lit. f GDPR.

The respective storage time of the cookies can be found from the overview in the cookie settings of the browser.

Most browsers support cookies by default; however, the settings of the browsers used can also be changed at any time in such a way that cookies are rejected and deleted. Users can also set the browser used to inform about the setting of so-called cookies and to decide individually on their acceptance or to exclude the acceptance of cookies for certain cases or in general.

In the event of non-acceptance of cookies, the functionality of the website may be limited – i.e. various functions of the website may no longer be available or may no longer function as intended.

Section 4. Tracking

The LIVEDAB website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). FOR this purpose, LIVEDAB has integrated Google Tag Manager into the LIVEDAB website.

Google Analytics uses so-called cookies, text files that are stored on users’ computers and which enable an analysis of the use of the website. The information generated by the cookie about the use of the website by the users is usually transmitted to a Google server in the USA and stored there.

LIVEDAB uses Google Analytics with the extension “_anonymizeIp()”. Since IP anonymisation has been activated, Google’s IP address will be truncated beforehand within EU Member States or in other contracting states of the Agreement on the European Economic Area (EEA). Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. A personal resitability can thus be excluded. Insofar as the data collected about the users is subject to a personal reference, this is immediately excluded and the personal data is deleted immediately.

On behalf of LIVEDAB, Google will use the information to evaluate the use of the website by users, to compile reports on website activity and to provide other services relating to website activity and internet usage to LIVEDAB. The IP address transmitted by the user’s browser within the scope of Google Analytics will not be merged with other data from Google.

Users can block cookies by setting their browser software accordingly, thus preventing the storage of cookies. LIVEDAB, however, informs the users that in this case they may not be able to use all functions of this website to the full extent.

Users of a browser software for which the above objections are not available is alternatively the possibility for a so-called Google Analytics opt-out. By clicking on the following link, an opt-out cookie is stored on the user’s device:

If the cookies are deleted, the link must be clicked again. The opt-out cookie only works in the respective browser and only for the respective domain.

LIVEDAB uses Google Analytics to analyze and regularly improve the use of the LIVEDAB website. The statistics obtained can be used to improve the offer and make it more interesting for users. The legal basis for the use of Google Analytics is Art. 6 sec. 1 p. 1 lit. f GDPR.

Section 5. Hosting

LIVEDAB uses a service of Hetzner Online GmbH for the purpose of storing customer data, Industriestraße 25 in 91710 Gunzenhausen / Germany, SCALEWAY S.A.S, BP 438, F-75366 Paris Cedex 08 / France, Google Ireland Limited, Gordon House, Barrow Street Dublin 4 / Ireland and the Amazon Web Services, Inc., P.O. Box 81226 in Seattle, WA 98108-1226 / USA.

The use of these service providers serves to safeguard the legitimate interests of LIVEDAB and on the basis of an order processing contract in accordance with Art. 28 sec. 3 p. 1 GDPR. The legal basis is Art. 6 sec. 1 p. 1 lit. f GDPR.

Section 6. Security

In the case of electronic contact of the customer via the LIVEDAB website, the data provided by the customer will be processed exclusively for further correspondence with the customer or for the processing of the respective request. The legal basis is Art. 6 sec. 1 p. 1 lit. f GDPR.

In order to prevent unauthorized access by third parties to the personal data of the customers, the transmission process is encrypted when using a contact form using the SSL/TLS protocol.

If storage is no longer necessary, the data will be deleted immediately or, if there are legal retention obligations, the processing will be restricted.

Section 7. E-mailing

When sending so-called transaction messages by e-mail, LIVEDAB uses the “Sendgrid” service to process the recipient data – i.e. a service of Twilio, Inc., 375 Beale Street, Suite 300, San Francisco, CA 94105 / USA.

The use of this third-party provider serves to safeguard the legitimate interests of LIVEDAB and is based on an order processing contract in accordance with Art. 28 sec. 3 p. 1 GDPR. The legal basis is Art. 6 sec. 1 p. 1 lit. f GDPR.

Section 8. Payment Service Provider

LIVEDAB uses external service providers (so-called payment service providers: Stripe) to process payments.

The customer’s payment data will be transmitted to the payment service provider, depending on the selected means of payment.

The transmission is necessary for the execution of the payment process and thus also for the fulfilment of the contract. The legal basis is Art.b.

The responsibility for the payment data lies with the respective payment service provider.

Information – including, but not only, through the responsible body of payment service providers, the contact details of data protection officers and categories of personal data processed by the payment service providers – is to be obtained through the respective payment service provider:

Section 9. Accounting software

In addition, LIVEDAB also uses an accounting software for accounting – i.e. the service “Billomat” of Billomat GmbH & Co. KG, Lorenzer Straße 31, 90402 Nuremberg / Germany.

Section 10. CRM & Customer Support

LIVEDAB uses the software “Hubspot” – i.e. CRM software and contact platform of HubSpot, Inc., 25 First Street, 2nd Floor, Cambridge, MA 02141 USA for the processing of general requests and questions to customer support.

In this respect, personal data of the users may also be processed and stored on the servers of these third-party providers, insofar as these are part of the communication processes with LIVEDAB.

The use of this third party serves to safeguard the legitimate interests of LIVEDAB and on the basis of an order processing contract in accordance with Art. 28 sec. 3 p. 1 GDPR. The legal basis is Art. 6 sec. 1 p. 1 lit. f GDPR.

Section 11. Collaboration Software / Communication

LIVEDAB uses the software “Microsoft 365” – i.e. collaboration software of the Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18 / Ireland for internal and external communication as well as the processing of documents

In this respect, personal data of the users may also be processed and stored on the servers of these third-party providers, insofar as these are part of the communication processes with LIVEDAB.

Section 12. Ensuring data security

LIVEDAB maintains technical measures to ensure data security, in particular to protect customers’ personal data from risks from data transmission and from knowledge from third parties. Therefore, when transferring data to LIVEDAB, the data is currently encrypted by Transport Layer Security (TLS 1.2).

LIVEDAB also secures the website and other systems by technical and organizational measures against the loss, destruction, access, alteration or dissemination of the data by unauthorized persons.

Section 13. Data economy

LIVEDAB processes and stores personal data of users only as long as this is necessary for the purpose of storage or as required by data protection regulations to which LIVEDAB is subject. As soon as the storage purpose is no longer necessary or a prescribed storage period expires, the data is routinely blocked or deleted.

Section 14. Legal basis

Insofar as the consent of the users is obtained for the processing of personal data, Art. 6 sec. 1 p. 1 lit. a GDPR is the legal basis for the processing. Consent can be revoked at any time without giving reasons with effect for the future. The revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation.

In the case of the processing of personal data necessary for the performance of a contract to which the user is a party, Art. 6 sec. 1 p. 1 lit.b GDPR is the legal basis for the processing. This also applies to such processing operations, which are necessary for the implementation of pre-contractual measures, which take place at the request of the user.

Insofar as processing of personal data is necessary for the fulfilment of a legal obligation, Art. 6 sec. 1 p. 1 lit.c GDPR legal basis for the processing.

In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 sec. 1 lit. d GDPR is the legal basis for the processing.

If the processing of personal data is necessary to safeguard the legitimate interests of LIVEDAB or a third party and the interests or fundamental rights and fundamental freedoms of the data subject do not outweigh these interests of LIVEDAB or a third party, Art. 6 sec. 1 p. 1 lit. f GDPR legal basis for the processing.

If the processing of a user’s personal data is based on such a balance of interests, the user may object to the processing. LIVEDAB no longer processes the personal data of the user in the event of an objection – unless compelling legitimate grounds for the processing can be proven, which outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims. However, if the user objects to the processing for direct marketing purposes, the personal data will no longer be processed for these purposes.

Section 15. Rights of the persons concerned

Users have the following rights with respect to LIVEDAB with regard to the personal data concerning them:

  • Right to correction (Art. 16 GDPR)
  • Right to erasure (Art. 17 GDPR)
  • Right to restrict processing (Art. 18 GDPR)

Users have the right to complain to the competent data protection supervisory authority about the processing of their personal data (Art. 77 GDPR).
